An unfair or wrongful dismissal is when your employer dismisses you without giving proper notice. If an employer terminates an employee’s service against the terms of the contract – unless the employee is involved in gross misconduct such as fighting or theft – an unfair or wrongful dismissals case can be brought against it. Unfair Dismissal is a statutory right and has a different legal perspective from wrongful dismissal, which is a contractual right.
