Intestacy
Any person who dies without making a valid will is said to have died intestate and their estate is managed according to intestacy laws. The deceased may never have made a will, may have had a solicitor make it but subsequently canceled the will, or may have not made a new will. In case of a person dying intestate, the law specifies who is entitled to inherit from the estate. There are many legal issues surrounding intestacy, such as whether a will was revoked, whether the deceased has left behind any children, and whether the person was married or in a civil partnership. If intestate, the amount a spouse/partner would inherit depends on factors such as which closest relatives are surviving and how much the estate is worth; the inheritance of the deceased’s children may be administered by a trust; and any other relatives may receive parts of the estate as per intestacy rules in a strict order.
